Waiver and release of liability.
I, the undersigned, acknowledge and agree to the following:
Assumption of Risk: I am voluntarily participating in group fitness classes offered by Summit Mentality Ltd, and I am aware that physical exercise can be strenuous and may result in injury. I understand that I am responsible for monitoring my own condition throughout the session and should any unusual symptoms occur, I will cease participation and inform the instructor.
Medical Evaluation: I confirm that I have consulted with my physician or have had the opportunity to do so regarding my participation in these fitness classes and that I am in good health and physically able to participate.
Release of Liability: In consideration of being allowed to participate in the fitness classes, I hereby release and discharge Summit Mentality Ltd, its instructors, employees, and agents from any and all claims, demands, and causes of action arising from my participation, including but not limited to, injury, loss, or damage to personal property.
Indemnification: I agree to indemnify and hold harmless Summit Mentality Ltd, its instructors, employees, and agents from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees brought as a result of my involvement in the fitness classes.
Photography/Video Release: I consent to the use of any photographs or video recordings taken during the fitness classes for promotional purposes by Summit Mentality Ltd. I understand that I will not receive any compensation for the use of these images.
Acknowledgment of Understanding: I have read this waiver and fully understand its terms. I acknowledge that I am signing the agreement freely and voluntarily and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
